Addendum: Use of MCP Servers

Version 2026-10-07. Annex to the Terms of Service.

1. Purpose and scope

This addendum applies when the Customer connects an MCP server (Model Context Protocol) to the chatbot in the administration panel, allowing the chatbot to look up information live via the server's tools. The addendum is an annex to the Terms of Service. With respect to MCP servers, the addendum prevails over the Terms of Service in case of conflict.

2. The Customer's choice of and responsibility for the MCP server

The Customer selects the MCP server and operates it itself or has an agreement with its provider. The Customer warrants that it has the right to use the server and the data it provides access to, and that the use is lawful. The Customer approves each tool and is responsible for ensuring that the tools' descriptions and responses are accurate and not misleading.

3. Data sent to the MCP server

When a user asks a question, the chatbot may send content from the question as arguments to the server's tools, and the server's responses may form part of the chatbot's answer. Fabrikken sends data to the server solely on the Customer's instruction, which consists of the Customer's connection and approval of the server and its tools. The Customer is the data controller for this data. The MCP server and its provider are not Fabrikken's sub-processor. The Customer is responsible for its own legal basis and for the necessary agreements, including a data processing agreement, with the server's provider.

4. Liability

Fabrikken is not liable for the MCP server's content, responses, availability or security, for the provider's processing of data, or for losses resulting therefrom, including answers from the chatbot based on the server's information. The limitation of liability in the Terms of Service otherwise applies. The limitation does not apply in case of Fabrikken's intent or gross negligence.

5. Fabrikken's safeguards and right to disconnect

The platform only calls tools declared read-only. If the server changes a tool, it is disabled until the Customer has approved it again. The first activation of a server is approved by Fabrikken. Calls are limited in duration, number of concurrent calls and monthly volume according to the Customer's subscription. A server that fails repeatedly, or whose address points to an internal network, is temporarily blocked and the Customer is notified. Fabrikken may disconnect a server without notice in case of suspected abuse, security risk or breach of these terms.

6. Acceptance and changes

Acceptance of the addendum is recorded with the name of the accepting administrator, the time and the version. If the addendum is changed, the new version must be accepted before the Customer can connect or activate an MCP server.
